Minutes: 

Board Members expressed a desire to review and re-evaluate the ranking procedures and process used by the Professional Services Selection Committee.

Ms. Rebecca Smith, President of A.D. Morgan Corporation, although disappointed in the outcome, accepted the Board's Final Order solely based on her concern that the project not be further delayed.  She thanked Board Members for their comments and offered to give input in the re-evaluation of the ranking process.

Recommendation

1. That the Recommended Order of the Administrative Law Judge dated September 17, 2015, is adopted in its entirety and incorporated herein by reference. Accordingly, the ranking of the Intervenor, Willis A. Smith Construction Inc., first for purpose of negotiating services for construction of the Suncoast Technical College (formally the Sarasota County Technical Institute) South Campus is upheld in the bid protest of Petitioner, A.D. Morgan Corporation, is denied.

2. The Exceptions to the Recommended Order filed by Petitioner, A.D. Morgan Corporation, are rejected. Petitioner has indicated on the record that it has agreed to the entry of this Final Order. Additionally, Petitioner  has agreed to forgo its right to appeal this Final Order.

3. In exchange for actions described in paragraph 2 above, the School Board agrees to waive any right it might have to seek and award of attorneys' fees and costs from Petitioner.
